Dear Dr. Lopez-Baez and Dr. Clawson:

Thank you for your recent correspondence regarding IC 25-33-1-3(g), which restricts the use of psychology tests and instruments to licensed psychologists or exempt professionals, and the proposed list of restricted tests and instruments. Governor O’Bannon reviewed your correspondence and asked me to respond.

The Indiana State Board has conducted extensive research to compile the proposed list of restricted tests and instruments. The Board will be considering all correspondence and recommendations regarding these tests before proceeding with the rule hearing in this matter.

All meetings of the Board are open to the public and you are welcome to attend. At this time the Board has not set a hearing date and time. hen the hearing has been scheduled the Board will publish the notice of time and place. If you desire to do so, you may appear at that hearing to voice your opinion regarding the proposed rule.

You requested copies of materials used by the board in developing the proposed list of restricted psychology tests and instruments in addition to other information regarding the board. We are in process of compiling the information you requested and will forward it to you under separate cover.

If you would like further information you may contact me at the Health Professions Bureau by calling (317) 233-4406 or you may write to 402 West Washington Street, Room 041, Indianapolis, Indiana, 46204.

Again, thank you for bringing your concerns in this matter to our attention.

Sincerely,

Barbara Marvel McNutt, Director

Restricted Test List Repealed in Indiana
May 17, 2007 - Legislation providing the Indiana State Psychology Board’s authority to create a restricted test list (RTL) has been repealed. HB 1821 removes language originally included in the counselor licensure law which passed in 1997. While this language has been in statute for ten years, a RTL was never successfully adopted despite multiple attempts by the Indiana Psychology Board in the last ten years. Effective July 1, 2007, this new law removes the authority of the Indiana Board of Psychology to create a Restricted Test List (RTL).
